The last thing they should have to worry about is the education their child receives at school. Yet, many school districts try to educate special needs children using a template that simply does not fit the child’s specific needs.

The Individuals With Disabilities Education Improvement Act of 2007 (“IDEA”) is the law of the land. It is a federal statute which governs the education of all children with disabilities who qualify for its protections. It does not allow for a school district to “cubbyhole” a child into whatever services it has available. The law mandates that a specific and individual education plan be formulated to educate the disabled child based upon the specific and particular needs of that child. The plan must allow the child to receive a meaningful benefit from his education. In this way, the special needs child can begin learning the skills necessary to ultimately integrate into the social fabric of our world.

Sadly, however, most parents of special needs children are completely unaware of the protections afforded their child by federal law, and their children are simply pushed through the school system, often with little benefit.
